Welcome to the PAM Marketing Automation Platform. By accessing or using this Customer Data Platform (“Platform”), you agree to comply with and be bound by these Terms and Conditions. Please read them carefully. If you do not agree, you must refrain from using the Platform.

2. Definitions

Platform: The PAM Marketing Automation Platform is a Customer Data Platform designed to collect, manage, and analyze customer data to enhance marketing strategies.
Customer Data: Any data related to individual customers or potential customers that is stored, analyzed, or processed on the Platform.
Service: All functionalities provided through the Platform, including data collection, segmentation, analytics, and reporting.

3. Data Collection and Usage

By using this Platform, you agree that you have the necessary permissions to collect and process customer data. You are responsible for ensuring that all data collected complies with applicable laws, including data privacy regulations.

The Platform uses data to provide insights, automate marketing tasks, and improve customer targeting. PAM does not claim ownership of customer data but reserves the right to use anonymized data for analytical purposes to enhance the Platform.

4. User Responsibilities

  • Users are responsible for maintaining the confidentiality of login credentials.
  • Users must ensure that their use of the Platform complies with all applicable laws and regulations.
  • Users agree not to misuse the Platform, including but not limited to unauthorized access, data scraping, or reverse engineering.

5. Data Privacy and Security

We are committed to safeguarding customer data and implementing industry-standard security measures. However, PAM cannot guarantee absolute security and disclaims liability for unauthorized access or data breaches that may occur despite our best efforts.

Users are advised to adopt additional security practices, such as multi-factor authentication, to further protect their data.

6. Intellectual Property

All intellectual property rights, including but not limited to code, software, branding, and trademarks related to the PAM Platform, remain the exclusive property of PAM. Users are granted a limited, non-transferable, and non-exclusive license to use the Platform as per these Terms and Conditions.

7. Termination of Service

PAM reserves the right to suspend or terminate access to the Platform at its discretion, including for violations of these Terms and Conditions or misuse of the Platform. Upon termination, access to customer data and the Platform’s functionalities may be permanently restricted.

8. Limitation of Liability

PAM will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Platform, including data loss, revenue loss, or business interruption. PAM’s liability in all cases is limited to the fees paid for the Platform in the preceding 12 months.

9. Amendments to Terms

PAM reserves the right to update or amend these Terms and Conditions at any time. Users will be notified of changes via the Platform or email. Continued use of the Platform after amendments implies acceptance of the revised Terms.

10. Governing Law

These Terms and Conditions are governed by the laws of the jurisdiction where PAM is registered. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the relevant courts.
